What can i do? (BEST ANSWER 10 PTS)?

My brother sent his laptop back to futurshop last week to fix the battery and keyboard and he got it back yesterday and in the cd drive was one of my games it just so happened that they took it out of the cd drive (cd drive was working properly before) and when he got it back yesterday the cd was in a bag and was scratched and un useable what can i do? can i tell them to replace it for me since they are the ones that screwed it up?
